Disputes

Enforcement of judgments

Obtaining a judgment is only part of the process: the judgment debtor may still not pay. We help judgment creditors choose and pursue the most suitable method of enforcement.

Methods of enforcement

  • Writ of seizure and sale of the debtor’s movable or immovable property
  • Garnishee proceedings to recover money held by third parties, such as bank accounts
  • Judgment debtor summons to examine the debtor’s means
  • Charging orders over shares or land
  • Bankruptcy proceedings against individuals, or winding-up proceedings against companies, where appropriate

Choosing the right approach

The right method depends on the debtor’s assets and circumstances. We assess these with you before taking action, to avoid unnecessary costs.
